TERMS & SALE CONDITIONS

PRICES
All prices are inclusive of the statutory value added tax (VAT). DEPLY KIDS® reserves the right to change prices without notice. Prices are subject to change. Transmission errors excepted.
We will deliver your orders as soon as possible. Generally, orders are being carried out twice a week. If by mistake an ordered product can’t be delivered, we will inform the client without delay. Exceeding the delivery time, not justified by force majeur (Act of God), the Customer may request cancellation of the sale and obtain within a maximum period of 30 (thirty) days the refund of the amount paid in connection with the sale. In all case, we shall not be liable for delays in delivery which are the responsibility of the commissioned carrier or custom clearance.
The customer shall be billed for shipping costs of returns resulting from refusal to accept delivery.

If you choose to pay by bank wire, you have to transfer the total order amount to our bank account within 3 business days. Note that we will ship out your order only after we have received your payment. In case there is still no payment entry after 7 days, DEPLY KIDS® will automatically cancel your order.
For a quick delivery, it is best to choose the payment by PayPal.
All payments must be made in accordance with the instructions given on the pages of the online store.

OFFER AND CONCLUSION OF CONTRACT
The Seller and your contracting partner is DEPLY KIDS represented by L.N.A. Company. The business relations between you and DEPLY KIDS are subject exclusively to the General Terms and Conditions set out below in the version that is in effect at the time of placing the order. DEPLY KIDS does not accept or acknowledge any deviating or contrary terms and conditions of the Ordering Party, unless we expressly agree to their applicability in advance in writing.

COMPLAINTS AND RETURNS
Complaints must be made within 7 (seven) working days following the delivery date; otherwise the delivery shall be deemed to have been accepted. You can contact us by e-mail: customer@deplykids.com
You can return all products ordered on deplykids.com within 7 (seven) working days following the delivery date in their original packaging and with a copy of the invoice. Returns charges are to be paid by the customer.
Products come with a label attached. Do not remove the label or relevant seal from the purchased products should you wish to return the purchased product.
Excluded from the above right to return goods are:
• Products where the tamper-evident seal or blister pack has been damaged
Products shall be returned at the customer’s expense and risk. DEPLY KIDS® will not accept returned products that are returned without the relevant label or seal or that have been altered from their original status or damaged.

RETENTION OF TITLE
The goods shall remain our property until payment has been made in full.

TRANSFER OF RISK
On sending the items out from deplykids.com the corresponding risks alienate to the buyer.

LIABILITY

The customer shall himself be responsible for the selection and use of the products. Claims for damages of any kind are excluded, unless we have caused the damage intentionally or through gross negligence. We shall not, under any circumstances, be liable for consequential or indirect damages. The commissioned carrier shall be liable for damage sustained during transit.

PRODUCT AVAILABILITY

All products on our website are supplied subject to availability. From time to time some of our products may be unavailable and we will contact you as soon as possible if we anticipate any delays. If an item that you wish to purchase is indicated as out of stock and you wish to place an order, just let us know via our contact form and we will notify you when the stock arrives.

QUALITY CONTROL OF ITEMS

All our items are made with the greatest care by carefully selected factories. We work in small productions so that the quality charter is respected as well as possible. However, the item you receive may not be exactly the same as the images in our store. Fabric patterns may differ slightly, as may colour or shape. This doesn’t mean that your order is faulty in any way.

PRODUCT USE

We cannot accept any responsibility if products are changed in any manner from the condition that they were supplied or in a manner not intended for use. Adult supervision is recommended at all times with toy and teething products.
